15. _________________ was then notified of the variables at 1343. The nurses administered oxygen and repositioned _________________ on her left side apparently in an effort to improve the tracing.

16. Nonetheless, the variable decelerations reoccurred until 1507 when _________________ labor had progressed to 9cm and zero station.

17. At this time, a prolonged deceleration down to 80- 90 beats per minutes occurred. The nurses notified _________________ at 1524. According to the records, _________________ advised the nurses that she would be done in her office soon.

18. At 1527, _________________ was completely dilated. The nurses allowed _________________ to push with one contraction and then to labor down while waiting for _________________. 19. At 1546, the nurses noted more variable decelerations to the 70’s.

20. At 1554, _________________ was pushing with the contractions.

21. By 1600, another prolonged deceleration was noted with minimal variability. According to the records, the nurses were not certain as to the presentation of the baby at this time, but nonetheless allowed _________________ to push and more variable decelerations appeared.

22. At 1609, the nurses telephone _________________ for delivery.

23. By 1615, more decelerations were noted.

24. _________________ finally arrived at the bedside at 1617 and _________________ was still pushing.

25. Variable decelerations continued and were noted at 1619. One minute later at 1620, the nurses performed scalp stimulation and got no response from the fetus.

26. _________________ belatedly ordered an emergent cesarean section at 1624 and delivered the baby at 1638 where a uterine rupture was discovered.

27. Unfortunately, by that time it was too late as, predictably, Baby _________________ was severely depressed at birth due to a lack of oxygen. Baby _________________’s Apgar scores (an assessment scale of fetal well-being with 0 being the worst and 10 being the best) were 1 at 1 minute, 1 at 5 minutes, 3 at 10 minutes and 4 at 15 minutes of age.

28. Baby _________________ required cardiopulmonary resuscitation for 11 minutes and was intubated and placed on a ventilator to help her breathe. Baby _________________’s first arterial blood gas pH was 6.56 with a base excess of minus 28.9, indicative of severe metabolic acidosis from hypoxia.

29. At approximately an hour and one half of life, Baby _________________ had clinical seizures.

30. An MRI on October 10, 2006, showed bilateral infarcts of the basal ganglia reflecting an acute hypoxic brain injury.

31. Baby _________________ remained hospitalized in the neonatal intensive care unit for 17 days until she was discharge home to her parents.

32. Subsequently, Baby _________________ was diagnosed with cerebral palsy, developmental delay, seizure disorder, gastrostomy and other severe and permanent medical conditions.

33. Had the Defendants adhered to the applicable standards of care, _________________’s condition and the condition of her fetus would have been appreciated and appropriate and timely measures would have been taken thereby avoiding Plaintiffs’ injuries.
